WAIVER AND ASSUMPTION OF RISK AGREEMENT
Whereas I recognize that the Sailing Adventure Club, Inc (SAC) is a Not-for-Profit organization for adults providing a variety of activities for its members and guests: and whereas I recognize that my activity, sail or travel arrangement with SAC, its officers and board or directors, any skipper or agent thereof may be hazardous by reason of the nature or the activity, travel arrangement or trip: and therefore, in consideration of being allowed to participate in an SAC activity or trip, I the undersigned, voluntarily waive, hold harmless and promise not to sue SAC, its officers and Board of Directors, my skipper or agent thereof with respect to any and all claims or liability of any kind arising out of my trip, activity or travel arrangement associated with SAC.  I additionally agree to be solely responsible for my intentional acts by myself that result in damage to equipment, boat or any other item owned by SAC, the skipper or other persons.  I accept the continuing responsibility to acquaint myself with the hazards and risks inherent in the activity and trip and I agree not to participate in my activity unless I fully understand all risks inherent thereof.  By signing below, I acknowledge personal liability for same.

I voluntarily assume and continue to assume the risk of my accident to my person or possessions that may occur on any SAC activity or trip.

I agree that this waiver shall continue in full legal force and effect until the day that I notify SAC in writing, that I no longer agree to the provisions of this waiver and this notice is acknowledged.  Immediate termination of club membership and club privileges shall be the result of such notice.  While SAC stresses safety in every phase of an activity, sailing is not without risk.  In signing below, I affirm that I am generally healthy and that I assume my and all risks whether on board a boat, swimming or on shore.  I will not hold SAC, its officers or board of directors, any member, skipper or first mate liable for my injury, illness, or damage incurred.  I understand that I am not required to participate in any activity and my choice to do so is voluntary.

I also understand and agree that photographs may be taken at SAC events for inclusion on the SAC  website and/or newsletter.  I understand that I may send a written request to the webmaster and/or newsletter editor requesting that a specific photograph in which I appear be removed or withdrawn in a timely manner.  I also understand that the SAC has no control over photographs taken by others during its events or in public places.
